Legislative Decree 24/2023 and protection of the whistleblower
The decree implements Directive (EU) 2019/1937 and regulates the protection of people who report violations of national or Union law capable of harming the public interest or the integrity of the entity.
The regulation protects the confidentiality of the identity of the whistleblower and prohibits retaliation in the foreseen cases. Reports must be detailed and based on reasonably reliable information.
Scope and correct use of the channel
The channel is intended for violations included in the scope of Legislative Decree 24/2023. It is not intended for commercial complaints, requests for assistance or exclusively personal disputes outside the scope of the law.
The reports and documentation are kept for the time necessary for management and in any case no later than five years from communication of the final outcome, in compliance with confidentiality obligations.
Company procedure
The company procedure must indicate channels, operating methods, managing entity and applicable protections. The final document approved by the company must be uploaded before publication in production.
